Fashion Law comprises the forms of protection for creations developed in this market segment. In this context, there are instruments available in both the Industrial Property Law and the Copyright Law. Because it is a branch of law that is under construction in Brazil, Fashion Law consists of a set of knowledge from several areas, applied specifically to the multifaceted context of the fashion industry.
Although there is no legislation specifically designed to regulate this market, there are legal instruments capable of governing the production chain and the fashion and design trade. In this way, creations in this field rely on multidisciplinary protection to obtain the due legal protection of the rights involved in the development and commercialization of their products.
The advice in this area is provided through both a preventive and a litigation approach, involving negotiation of sales platform contracts, resolution of conflicts of interest, and defense against misuse.
